These Terms and Conditions apply to all purchases of product from this site. Please read the following Terms and Conditions carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that apply to your purchases.

Terms and Conditions are subject to change. Any and all updates will be posted to this page.

These Terms and Conditions constitute the entire agreement between us as to their subject matter and supersede and replace all prior and contemporaneous oral and written agreements. This Agreement may not be altered, supplemented, or amended by the use of any other document unless otherwise agreed to in a written agreement signed by both you and MESLifeSafety.com.

Acceptance of Terms

MESLifeSafety.com, a MES company, hereinafter referred to as “MES,” reserves the right to accept or reject any and all orders, regardless of the manner in which the order is made. MESLifeSafety.com reserves the right to update these Terms and Conditions (“T&Cs”) at any time without notice to you. The most current version of the T&Cs can be reviewed by clicking the “Terms and Conditions” link located at the bottom of all MESLifeSafety.com web pages.

Place of Sale

Except as otherwise provided in these T&Cs, title and all rights, risks, and rewards of ownership, including but not limited to risk of loss of or damage to a product, pass to you upon shipment of the product from MES or its agent. You must notify MES within twenty-one (21) days of the date of your invoice or acknowledgment if you believe any part of your purchase is missing, incorrect, or damaged.

Unless you provide MES with a valid tax exemption certificate applicable to your purchase of product and the product shipping destination, you are responsible for sales and other taxes associated with the order.

These T&Cs and all sales of products and services are governed by and subject to the laws of the State of Connecticut and the United States of America. The parties submit to the exclusive jurisdiction of any state or federal court for Fairfield County, Connecticut, having competent jurisdiction in the event legal proceedings arise from any dispute.

No change, modification, or revision of your order shall be valid unless agreed to in writing by MESLifeSafety.com and/or MES. Any terms and conditions set forth in the buyer’s purchase order shall not materially alter the terms and conditions set forth herein. To the extent that any term or condition in the buyer’s purchase order conflicts with these T&Cs, these T&Cs shall prevail.

Site Transactions

The prices and descriptions of our products made available on this site are subject to availability, do not constitute an offer, and may be withdrawn or revised at any time prior to our express acceptance of your order in the manner set forth herein. An order placed by you constitutes an offer by you to us to purchase products or services under these T&Cs and is subject to our subsequent acceptance.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account or credit card and/or orders that use the same billing and/or shipping address.

In the event we make a change to or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. If we limit quantities in an order or cancel an order altogether, we will refund any prior payment you made for the quantities not sold or the canceled order.

If you refuse or fail to take delivery of products provided in accordance with these T&Cs, any risk of loss or damage to the products shall nonetheless pass to you, without prejudice to any other rights or remedies MES may have. MES shall be entitled to immediate payment in full for the products or services delivered and may either effect delivery by whatever means MES considers appropriate or store the products at your risk.

You shall be liable to pay on demand all product-storage costs and any additional costs incurred as a result of such refusal or failure to take delivery. Ten (10) business days after the agreed date for delivery, MES shall be entitled to dispose of the products in such manner as MES determines and may set off any proceeds of sale against any sums due from you.

Restrictions on the Sale of Specific Products

MESLifeSafety.com does not sell or ship internationally at this time. We apologize for the inconvenience.

When you place an order for products that are subject to any legal restrictions, you warrant to us that you are authorized to make such a purchase, all information you provide is accurate and current, and you are in compliance with all local, state, and federal laws concerning the order and your intended use of the products.

As an additional measure to protect the public, we may verify the employment of any person ordering such items. We apologize for any inconvenience this may cause.

Limited Warranty

MES makes no warranties, express, implied, or statutory, with respect to the products or services MES provides, including, without limitation, any warranties of merchantability or fitness for a particular purpose.

The warranty for all goods purchased through MESLifeSafety.com is limited to the manufacturer’s limited warranty policy for the goods purchased. Most manufacturers warrant their products to be free from manufacturing defects in materials and workmanship for a specific period of time. Contact Customer Service for a copy of the manufacturer’s warranty.

MES’s sole liability and the customer’s sole remedy for breach of any warranty is limited, at MES’s option, to either: (a) the repair or replacement of the defective product; or (b) the refund of the purchase price of the defective product. Returns of allegedly defective products are subject to the procedures in the “Returns, Exchanges, and Refunds” section below, including any manufacturer inspection or evaluation. Return-shipping responsibility will be determined under that section and applicable law.

Limitation of Liability

To the maximum extent legally permitted, whether or not MES was advised of the possibility of damages, and whether or not the limited remedies provided herein fail of their essential purpose, our aggregate liability—whether for breach of contract, tort, or any other legal theory—shall in no circumstances exceed the cost of the products you ordered that are most closely related to your damages.

In no event shall MES be liable for special, punitive, incidental, or consequential damages, including any damages resulting from loss of use, loss of profit, or loss of business, whether arising out of or in connection with the performance of the products or services or by any other means, and regardless of the form of action upon which a claim for such damages may be based, whether in contract, tort (including negligence), strict product liability, or any other legal or equitable theory. These limitations shall apply even if any limited remedy fails of its essential purpose.

Returns, Exchanges, and Refunds

General Return Eligibility

Subject to the exclusions and conditions below, MES may accept the return or exchange of eligible products purchased from MESLifeSafety.com when the customer requests a Return Merchandise Authorization ("RMA") within thirty (30) calendar days after delivery. Products must be received by MES within fifteen (15) calendar days after the RMA is issued. An RMA does not guarantee that a return will be approved or that a refund or exchange will be issued.

To qualify, a product must be unused, uninstalled, unwashed, unworn, unmarked, unaltered, uncontaminated, complete, and in new and resalable condition. The product must be returned with all original packaging, labels, tags, manuals, certificates, accessories, components, promotional items, and proof of purchase. Apparel, footwear, helmets, and other wearable products may be tried on solely to determine fit, but may not be placed into service, worn outside, marked, customized, or otherwise used.

Except for products opened solely to inspect contents or determine fit, opened products are not eligible for a refund and may be eligible only for exchange of the identical item, subject to MES approval. Products with opened, damaged, altered, or missing packaging may be refused or may be subject to additional inspection, repackaging, or restocking charges.

Return Authorization and Shipping

  1. Contact MES Customer Care at 1-877-711-5557 to request an RMA and the correct return location.
  2. Include the RMA, order number, packing slip or other proof of purchase, and any return documentation requested by MES.
  3. Pack the product securely and ship it prepaid using a trackable and insured method. The customer is responsible for all return-shipping charges unless MES provides a return label because MES verified that it shipped an incorrect product or that the product arrived damaged or defective.
  4. Do not send returns freight collect or to an address other than the location specified in the RMA. Unauthorized returns, returns without a valid RMA, and collect shipments may be refused.

Title to and risk of loss for a returned product remain with the customer until the product is received by MES at the authorized return location in undamaged condition. MES is not responsible for products lost, damaged, delayed, or misdirected during return shipment.

Inspection and Restocking Charges

All returns are subject to receipt, inspection, testing, and approval by MES. MES may reject a return or reduce the refund if the product is not in the condition required by this policy, is missing packaging or components, has been used or installed, presents a safety or contamination concern, or differs from the product originally shipped.

To the extent permitted by applicable law, MES may deduct a reasonable restocking and handling charge of up to twenty percent (20%) of the product purchase price from any approved non-defective return. Special-order, non-stock, drop-shipped, or vendor-controlled returns may also be subject to vendor-imposed restocking charges, return freight, inspection charges, repackaging charges, and other nonrecoverable costs. MES may ship a rejected return back to the customer at the customer’s expense.

Non-Returnable and Final-Sale Products

The following products and charges are final sale and are not eligible for return, exchange, or refund except where required by law or where MES confirms that it made an order-fulfillment error:

  • Products that have been used, installed, placed into service, washed, worn, marked, damaged, altered, repaired, assembled, programmed, calibrated, tested, contaminated, or exposed to smoke, chemicals, biological materials, or other hazardous conditions.
  • Custom-made, personalized, embroidered, engraved, lettered, patched, tailored, cut-to-length, configured, modified, or otherwise customer-specific products.
  • Special-order, non-stock, discontinued, manufacturer-direct, or drop-shipped products, unless MES and the applicable vendor approve the return in writing and the customer pays all applicable charges.
  • Clearance, closeout, liquidation, demo, used, "as is," and products otherwise identified as final sale.
  • Respiratory masks and facepieces, cartridges, filters, hoods, earplugs, medical and first-aid products, infection-control products, disposable PPE, body armor, ballistic products, and other health, hygiene, or life-safety products after the seal or packaging has been opened.
  • Pharmaceuticals, IV solutions, products with an expiration date, sterile products, food, beverages, and other perishable or time-sensitive products.
  • Hazardous materials, chemicals, aerosols, fuels, batteries restricted from return shipment, calibration gas, compressed-gas cylinders, extinguishing agents, and other regulated materials.
  • Gift certificates, gift cards, downloadable or electronically delivered products, software licenses, subscriptions, and activated warranties or service plans.
  • Products ordered or designated as final sale in connection with emergencies, disasters, pandemics, allocations, supply shortages, or other extraordinary demand conditions.
  • Shipping, freight, handling, hazardous-material, delivery, installation, inspection, calibration, programming, customization, expediting, service, training, and other charges for services already performed.
  • Emergency vehicles, apparatus, fixed systems, rentals, repair services, and other products or services governed by a separate quotation, contract, statement of work, or service agreement.

Incorrect, Damaged, Defective, or Missing Products

Customers must inspect each shipment promptly. Claims involving shortages, incorrect products, visible shipping damage, or products damaged on arrival must be reported to MES within twenty-one (21) calendar days after the invoice or acknowledgment date, as provided elsewhere in these T&Cs. The customer must retain the product, packaging, shipping label, and all packing materials and provide photographs or other evidence reasonably requested by MES. Visible shipping damage should also be noted with the carrier at delivery.

MES may, at its option, repair the product, replace it, issue an account credit, refund the eligible purchase price, provide replacement parts, or refer the matter to the manufacturer or carrier. Products that have been placed into service and are claimed to be defective are subject to the applicable manufacturer’s warranty and the Limited Warranty section of these T&Cs. MES may require manufacturer inspection or evaluation before authorizing any remedy.

Exchanges

Eligible exchanges are subject to product availability and the same conditions as returns. The customer is responsible for returning the original product and for any price difference, taxes, or additional shipping charges. MES may process an exchange as a return and a new order. Products needed immediately should be purchased under a separate order rather than held pending completion of the return inspection.

Refunds and Credits

Approved refunds will be issued to the original payment method, or as an account credit for purchases made on commercial credit terms, generally within ten (10) business days after MES completes its inspection. Financial institutions may require additional time to post a refund. Original and return shipping charges and other nonrefundable charges will not be refunded unless the return results solely from a verified MES fulfillment error or applicable law requires otherwise.

If a return causes an order to no longer qualify for a discount, rebate, free product, free shipping, or other promotion, MES may recalculate the order and deduct the value of the lost benefit from the refund. Promotional or free products must be returned in eligible condition or their stated or reasonable value may be deducted. Refunds of taxes will be handled as required by applicable law.

Order Cancellations

Cancellation requests are not guaranteed. An order may not be canceled after it has entered processing, production, customization, fulfillment, or shipment. Custom, special-order, non-stock, and manufacturer-direct orders may become noncancelable when MES submits the order to the manufacturer or begins work. If MES agrees to a cancellation, the customer remains responsible for work performed and for any nonrecoverable vendor, freight, or processing charges, to the extent permitted by law.

MES Discretion and Applicable Law

MES reserves the right to refuse or limit any return, exchange, refund, or account credit that does not comply with this policy, involves suspected abuse or fraud, or is otherwise not permitted by MES or the applicable manufacturer. Nothing in this policy limits any nonwaivable right or remedy available under applicable law, including rights relating to merchandise that MES does not ship within the required or agreed time.

Privacy and Protection of Personal Information

Your submission of personal information to and through this site is governed by our Privacy Policy, which is also available through the site footer (the “Privacy Policy”). This Agreement incorporates by reference the terms and conditions of the Privacy Policy.

Errors, Inaccuracies, and Omissions

Occasionally, information on our site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, or availability. We reserve the right to cancel any orders resulting from such errors.

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the site is inaccurate at any time without prior notice, including after you have submitted your order.

Indemnification

You agree to defend, indemnify, and hold MESLifeSafety.com and MES harmless from and against any and all claims, damages, costs, and expenses, including attorneys’ fees, arising from or related to your use of the site and/or your breach of any representation, warranty, or other provision of the T&Cs.

You shall indemnify us against any and all liabilities, claims, and costs incurred by or made against us as a direct or indirect result of our performing services or carrying out any work on or to the products where this has been done to your—or your representative’s—specific requirements or specifications, causing infringement or alleged infringement of any proprietary rights of any third party.

Our obligation to you with respect to claims of third parties arising out of or relating to any products sold by MES to you from this site shall be limited to those obligations contained in our statement of limited warranty set forth herein.
